If our FHA loan has a non-signing spouse do I still qualify for the first time home buyers credit?

Both my husband and I are first time home buyers.
For clarification: we are both first time home buyers and I will file jointly. I don’t want to get the credit twice just the credit itself

    A first-time buyer is defined as someone who has not had a property in their name in the last three years from the sale of one to another.

    You and your husband must file separately for him to get the credit, but you can only get the $8K once.

    The credit is per house… not by how many people signed on the dotted line on the mortgage contract.

    One of you (most likely the one that actually is held responsible for the mortgage) can claim it on their taxes. If you file “married filing jointly” you get to share it just like the normal tax returns.

    But no… you don’t get it twice if you file separate.
