Facing foreclosure? Info at www.consumerwarningnetwork.com may help. Your goal is to make certain the institution suing you is, in fact, the owner of the note. There is only one original note for your mortgage that has your signature on it. One such case is profiled on CNN’s Your Money.

@conworldus So who do represent? The criminal banks, criminal government or criminals on wall street. It was a great sting. Yes you are right about one thing – regular people need to be aware that they are targeted by predators day and day out. Who can you trust these days? Not the government, not banks, not wall street, etc etc etc. Don’t blame the addict – blame the drug pusher.

printing money and losing deeds. The only instruments in america’s dodgy finance industry are your bankers. There all tools. When will you people push the button and flush them?

I’m tired of people blaming the banks for foreclosures. Guess what, no one is forcing you to borrow from the banks. If you can’t afford to buy, then you need to rent. Plain and simple. No one should feel sorry for you getting kicked out of your homes because they’re not YOUR homes to begin with. They were the banks. It’s not your home until you pay off the loan and you’re given the deed/title for the property. Tough shit. Back to the apartments you go!

the banks go for the throat any chance they get, in this one instance the tables have turned but as soon as its the homeowner going in for the kill we get these idiots pointing out that this is not fair/cheating, ya no shit it is but the banks cheat all the time and no one holds them accountable, as they state “its just business”, so go for the kill homeowners, ride the loophole to a free house if you can & do it guilt free after all its just business.

Must plead the absence of payment default. -
    September 30, 2010, MDL court
“Borrowers who are unable to allege that they were timely paying their obligations will not be able to pursue affirmative claims for wrongful non-judicial foreclosure based upon “splitting the note” theories or other challenges to MERS’ status as mortgagee.”

    ———
Also you can have no wrongful foreclosure claim before foreclosure. Foreclosure is a matter of private contract in non-judicial States.

Katherine Porter states that Wrongful foreclosure is when the house is
foreclosed on and there is no default.
Nearly all securitized loans are current.
The obligation is not in default because the Securitization Trustee and the investors have received all payments.

The servicers and securitization trustees are required and obligated to make the payments whether or not they receive the payment from the homeowner.

i know there is a law out there, i dont remember it but if you attempt to pay a bill and they refuse you must offer it again and if they refuse it twice all you need to do is say thanks for paying the bill. because this is a law i remember about paying a credit card or other bills so i wonder if this would be the same for a morgage.
